Making a Valid Claim to an Estate

A frequently asked question is "Can I challenge a Will?".  

In order to successfully challenge a Will you must be:-

  • Legally married to the deceased
  • A Child or Grandchild of the deceased
  • A Parent, or close family member, such as Aunt or Uncle
  • Cohabiting and in a relationship with the deceased for a period of two years, including the time the deceased passed away.  However, the legal spouse is still entitled to a portion of the estate called a "legal Right Share".
  • A beneficiary of the Will
  • A beneficiary of a previous Will, and the new Will deemed invalid
  • A debtor to the estate
