Common Questions

How do I claim?

It couldn’t be easier. Call us today on 0121 355 0011 and speak directly to one of our qualified accident claims advisors. You can also contact us using our online form, and we will call you back as soon as possible.

During your call, we will assess whether you have a case and, if you do, we will start work on your claim straight away. Our step-by-step guide on the claims process shows what is involved in bringing a claim.

Should I claim?

The insurance industry tries to discourage people from bringing claims.  But it is you who has suffered the injury, inconvenience and the financial losses. Why should you have to suffer these because someone else has been negligent? If you have suffered injury because of someone else’s fault then you have the right to make a compensation claim.

Often it is only after someone brings a personal injury claim, that the person or company at fault take proper precautions. By bringing a claim you could be reducing the likelihood of somebody else experiencing the same accident. It may seem an intimidating process at first, but here at Winclaim we are committed to taking the weight off your shoulders and helping you every step of the way. Call us today and speak to one of our qualified accident claims advisors to find out more.

What can I claim for?

You can claim for both the actual physical/psychological injury sustained and also for any financial losses caused by the accident.

You can claim for loss of earnings and overtime, the cost of medical treatment such as physiotherapy and travel expenses.  You can even claim for the cost of care and assistance provided by your friends and family.

If you have been involved in a car accident you can claim for your vehicle damage or insurance excess.  If you hired a car then this can be reclaimed. We can fully advise you on what can be claimed so that you receive fair compensation for the accident which was not your fault. Get in touch with us today to find out how we can help.

I am not sure if I can claim, how can I find out?

It’s absolutely fine to contact us for advice, even if you aren’t sure whether you can make a claim.

We were contacted by an elderly lady two years after a car accident.  She was a passenger in a car driven by her husband.  He made a mistake and caused an accident and she suffered very serious injuries.  She thought she could not claim because it was her husband who was at fault.  We advised her that her husband was insured for the accident and she successfully brought a claim for more than £100,000 which was paid by his insurers.  This compensation did not put her injuries right but it meant that she could pay for the care and assistance she desperately needed.

Our qualified accident claims advisors will listen to your circumstances and then advise you on whether you have a good chance of success. At Winclaim, we can help you from your initial enquiry all the way through to the end of the claims process. Call us today on 0121 355 00 11 or use our online contact form to get in touch.

I think I might be at fault for the accident, can I still claim?

The best thing to do if you are unsure of who is responsible for your accident is to contact us. We will listen to your circumstances and advise you if we can help. Even if you are partly responsible for your accident, you may still be able to claim some compensation.  We are happy to consider all cases, even if they are not straightforward. All of our specialist accident claims lawyers have high levels of expertise to help guide you through the process from beginning to end, no matter how complex the case.

How do you get paid?

If you are successful our fees are paid by the party at fault. This is on top of the compensation you receive.

Will I have to pay anything?

You do not have to pay anything up front or as the cases progresses.

We win over 90% of cases that we take on but if you lose then we will not charge you.

You must though ensure you comply with your responsibilities.*

How long will my case take?

How long a personal injury case will vary.  A claim for a person who has suffered a spinal injury will take a lot longer than a claim for someone who has suffered whiplash in road traffic accident. Where injuries are minor and the other party admits they were at fault for the accident then the claim might only take 2 months.

A straightforward car accident claim will usually take 3 to 7 months. A straightforward accident at work case will typically take between 6 and 12 months.  Cases will take longer where a person or company deny they were at fault or where their insurers will not make a reasonable offer.  Usually we are acting for you under a no win, no fee agreement so we will not get paid until we achieve a successful result for you. This means it is in our interest for your claim to be completed as soon as possible.  Get in touch with us today and, based on your circumstances, we can give you a time estimate for your claim.

How much compensation will I get?

Your accident compensation will be based on what has been awarded by the courts in the past for accidents with similar circumstances to yours. The amount you will receive depends on the type and extent of your injury, your physical/psychological pain, discomfort or loss of amenity and whether you have suffered other financial issues such as loss of earnings or medical or care costs. We can give you personalised advice on how much we think you may receive but  this site contains a guide as to the amounts of compensation for pain and suffering.

I am not sure I want to bring a claim now. I just want some information – can you help?

Yes, you can call us for an informal talk about your accident.   At Winclaim, we appreciate how difficult the decision to start a personal injury claim can be. Our qualified advisors are committed to giving you all the help you need, even before you’ve decided whether to pursue a claim.  Call us and we will talk to you about bringing a claim and answer any questions you might have.  If you are not happy  you do not have to proceed and it won’t have cost you a thing to find out more.

What happens if I lose?

Nothing. Because of our ‘no win, no fee’ policy, we do not charge if you lose.

We will make sure you are insured for things like the cost of medical records and reports and any defendants’ fees. You won’t be left out of pocket.*

Will I have to go to court?

The fear of going to court is often the biggest reason victims of personal injury choose not to pursue a claim. Court cases are expensive for Defendants to fight and only about 1% of cases go to Court.  That means 99% of cases settle amicably.

Our qualified accident claims advisors are able to give you full support throughout the entire process of your claim, including representing you in court proceedings. We do all the work for you so that even if your claim goes to court, you won’t have to worry about a thing. Contact us today and we will be happy to give you all the advice and help you need.
