Over the years, we have dealt with some unusual scenarios.
We obtained a court order to prevent someone using a right of way to cause a nuisance very close to our client’s residential property. This case was unusual because the court imposed an exclusion order around the entire property and surrounding land.
Image what it was like to buy your dream home only to find out a right of way ran through the garage. While we could not remove the right of way, we obtained substantial compensation from the company of unlicensed conveyancers who acted for the purchaser. We also negotiated a settlement to have the right of way diverted.
In another case, during development of offices in the centre of Birmingham a developer’s crane was swinging over another property. This trespassed on the air space belonging to the “lower property” and we obtained compensation for the trespass and agreed a payment for the use of the airspace.
